Restoring MSGP Compliance
An industrial facility operating without the Florida Multi-Sector Generic Permit (MSGP). The facility was recently inspected by the Florida Department of Environmental Protection (FDEP). Despite over a decade of operations without prior issues, the facility was found to be out of compliance due to gaps in knowledge and implementation of critical stormwater requirements.
Under the MSGP, facilities are required to maintain a facility-specific Stormwater Pollution Prevention Plan (SWPPP), conduct quarterly facility inspections and visual monitoring of stormwater discharges, perform an annual comprehensive review of the SWPPP and employee training, and submit all applicable Discharge Monitoring Reports (DMRs). In this case, the facility had not yet developed a SWPPP, lacked effective Best Management Practices (BMPs), was not conducting quarterly visual inspections, and had missed required analytical monitoring submissions.
KCI immediately stepped in to support the client, leveraging deep regulatory knowledge and practical compliance expertise. We developed a fully documented SWPPP tailored to the facility’s operations and completed a thorough Annual Comprehensive Site Compliance Evaluation. Beyond simply delivering corrective actions, KCI actively collaborated with FDEP on the client’s behalf, presenting the facility’s proactive remediation plan and clarifying steps already underway. This partnership approach helped soften the potential implications of non-compliance while ensuring the facility met all regulatory obligations promptly and sustainably.
Through this engagement, the client not only regained compliance but also gained confidence and clarity in stormwater management, with KCI providing the guidance and systems needed to prevent future violations. This case underscores how strategic expertise and collaborative regulatory relationships can turn a compliance challenge into a positive, forward-looking outcome.
