Operators of construction activities that plan to disturb one or more acres of land, or that will disturb less than one acre but are part of a larger common plan of development and meets either of the following two criteria will require National Pollutant Discharge Elimination System (NPDES) permit coverage.  The operator has operational control over construction plans and specifications, including the ability to make modifications. Secondly, the operator has day-to-day operational control of those activities at a project that are necessary to ensure compliance with the permit conditions. 

Once you are ready to go, a construction site operator will be expected to develop and document the Stormwater Pollution Prevention Plan (SWPPP) and then file with the Florida Department of Environmental Protection (FDEP) a Notice of Intent (NOI).  Submitting a NOI form is the beginning process of obtaining your Florida CGP to begin your construction project.   You must submit a completed NOI form and have your SWPPP completed, to get coverage under the Generic Permit for Stormwater Discharge.  Additionally, you must submit the appropriate generic permit fee with the NOI Form to obtain permit coverage.

The NOI is the first step defined by the National Pollution Discharge Elimination System to regulate point source discharge for construction activity and industrial facilities. Operators are required to obtain an NPDES permit before they can discharge water. The NOI serves as the operators notice that discharge meets all of the eligible conditions specified in the permit and SWPPP.  Large and small construction activities must submit and complete the Notice of Intent (NOI) form for coverage under the Generic Permit for Stormwater Discharge.
