A Notice of Violation (NOV) is a formal notice a construction site operator or contractor may receive from a regulatory agency (EPA, state, or local government) stating that the site is not meeting stormwater management requirements. It will outline which parts of the site’s stormwater controls or practices are out of compliance and what actions are required to fix the issues.

An NOV can result from a routine inspection by the county or municipality, a state/FDEP visit, or even an anonymous complaint about the site. When this happens, the operator is given a short window (often around 30 days, depending on the agency) to correct deficiencies, document repairs, and respond in writing.

 What To Do if You Receive a Stormwater NOV

If your construction site receives a Notice of Violation (NOV), you are required to correct the issues identified in the letter within the timeframe given by the regulator. Ignoring or delaying those corrections can lead to civil penalties—often hundreds or even thousands of dollars per day that the violation remains unresolved.
